Terms of Service
These terms govern your use of zapcard.com.au and ZapCard profiles, company workspaces and physical NFC cards, provided by Konquer Media Pty Ltd (ABN 15 685 811 492, “ZapCard”, “we”, “us”). By placing an order or creating an account, you agree to these terms.
1. The product
ZapCard is a physical NFC business card with an embedded chip. The chip points at a digital profile URL that you control. The card hardware and the digital profile service work together. Company workspaces are available separately, without a physical-card purchase.
2. Your account & profile
- You may create one account per email address.
- A personal Free account holds 1 profile; Premium ($5/mo) holds up to 5 profiles.
- You can switch which profile your physical card points at, at any time, via your dashboard.
- You are responsible for the accuracy of information on your profiles and for any content you upload (photos, banners, links).
- You must not impersonate another person, business, or brand on a ZapCard profile.
- You may not use ZapCard to distribute illegal content, malware, harassing material, or content that infringes another party’s rights.
2.1 Free and Team company workspaces
A Free company workspace requires no card purchase or payment. It includes individual staff logins, shared profile names, all-time profile-open counts and contact totals. Opens combine recorded taps and shared-link visits; they do not identify unique people.
Team costs AUD 99 per workspace per month, including GST. It adds detailed activity, shared CRM with assignments, notes and follow-ups, and editing of profiles whose owners grant company editing permission. Physical cards are purchased separately. Buying cards or a personal Premium subscription does not activate Team features.
Sharing a profile and granting editing permission are separate choices. Workspace access depends on your role and permissions. The current self-service workspace supports up to 500 members, including its owner.
Team is a recurring monthly subscription. The workspace owner can manage renewal through Manage billing. For cancellation assistance or a service problem, see our Refund Policy. Cancelling renewal, requesting a refund and deleting an account are separate actions.
3. Orders, shipping, and timing
After you place an order:
- You receive an order confirmation and can build your profile immediately.
- Your card is produced and dispatched via Australia Post shipping.
- Cards typically ship within 7 business days from order.
If we cannot meet these timelines for reasons beyond our control (manufacturing delay, courier issue), we will notify you and offer a refund or expedited replacement.
4. Pricing
All prices are in Australian Dollars and include GST. The single-card price is $49 AUD one-time, and Australia Post postage within Australia is included in that price. Your card works fully on its own. An optional Premium subscription ($5/month) adds extra profiles under one account. Cards are $39 each on orders of 5 or more. Custom physical-card pricing is also available via our team-quote form and is invoiced separately.
5. Australian Consumer Law & warranties
Nothing in these terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). In particular:
- Your ZapCard is guaranteed to be of acceptable quality and fit for purpose.
- If your card has a manufacturing defect, you are entitled to a replacement, refund, or repair.
- If the digital profile service has a major failure that we cannot fix within a reasonable time, you may cancel and request a refund.
See our Refund Policy for the full process.
Separately from those statutory rights, every card carries a 12-month warranty from delivery: one free replacement card, shipping included, if the chip stops reading or the card fails under normal use. That warranty is in addition to your Australian Consumer Law rights and does not limit them, full terms in section 4 of the Refund Policy.
6. Service availability
We use Vercel hosting and a Neon/Postgres database for the application and aim for 99.9% availability, but we do not guarantee uninterrupted service. If a profile is unreachable for more than 24 hours due to our outage, contact us for credit or compensation.
7. Limitation of liability
To the extent permitted by Australian law, our total liability for any claim arising from your use of ZapCard is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages. Nothing in this clause limits or excludes liability that cannot be limited or excluded under Australian Consumer Law.
8. Account termination
You may delete your account and profiles at any time by emailing support@zapcard.com.au. We may suspend or terminate accounts that violate these terms, after written notice and a reasonable opportunity to cure where appropriate.
9. Changes to these terms
We may update these terms. We will notify active customers by email at least 14 days before material changes take effect. Continued use of the service after that point means you accept the new terms.
10. Governing law & disputes
These terms are governed by the laws of Victoria, Australia. Disputes will be resolved in Victorian courts, except where Australian Consumer Law gives you stronger rights. Before any court action, we ask that you contact us to attempt informal resolution.
